Is Sports Betting Legal in Montana?
Yes, it is. Montana is one of the first U.S. states to legalize sports betting following the Supreme Court’s repeal of the Professional and Amateur Sports Protection Act (PASPA) in 2018. Governor Steve Bullock signed HB 275 into law in 2019, legalizing sports betting in the state and establishing a framework for its regulation. This law granted the Montana Lottery exclusive authority to operate retail and online sports betting.
Another sports betting bill, SB 330, introduced by G. Hertz, proposed allowing outside operators to offer betting services in the state as well. However, Governor Bullock opted not to endorse this bill, allowing Montana Lottery to maintain its monopoly over the sports betting market.
Although legal, sports bettors can only place wagers at designated kiosks or via the Montana SportsBet app at licensed Montana sports betting locations/terminals. The state, home to only about 1.1 million people, has hundreds of certified, in-person sportsbook locations, which include casinos, restaurants, hotels, bars, and even convenience stores. Montana sports betting laws allow for more retail sportsbooks than nearly all states in the US. Therefore, there is probably a nearby designated kiosk wherever you reside in the state.
Sadly, there is a cap on betting amounts. In-play bettors are limited to $250 wagers, while you can bet up to $1,000 when you do so online instead. Unlike many other states, there are no restrictions on college betting. In 2024, the overseeing body, Montana Lottery, declined an NCAA request to ban prop bets on college players.
Although there are no explicit prohibitions on college betting, you are less likely to find prop betting odds on Montana’s primary college teams—the University of Montana and Montana State—as they play at the second-tier FCS level, where there are higher integrity risks due to limited transparency and media scrutiny compared to the FBS.
Is DFS Legal in Montana?
Daily Fantasy Sports (DFS) isn’t legal in Montana. The Treasure State is one of five (5) U.S. states where internet-based fantasy sports games are deemed illegal. The state made its position clear in MCA 23-5-802 where it states that:
“It is lawful to conduct or participate in a fantasy sports league, including a fantasy sports league that is operated under a pari mutuel system of wagering regulated under Title 23, Chapter 4. It is unlawful to wager on a fantasy sports league by telephone or by the internet.”
In other words, the law allows the formation of a fantasy sports league in person. However, calling in picks or participating in contests via DFS operators is prohibited.
Several bills have been proposed over the years to legalize DFS, but none have been passed. Notable mentions are HB 181, SB 25, and most recently, HB 265.
HB 181 proposed that the Montana Department of Justice’s Gambling Control Division regulate major DFS operators’ activities and redefine DFS as a game of skill rather than gambling. However, lawmakers concerned about the spread of a gambling endemic opposed this.
SB 25 also proposed a licensing and regulatory system for DFS operators but faced considerable opposition. So did HB 265, which aimed to legalize DFS and included provisions for registration, operator licensing fees, and player protection through fair play standards and rules transparency.
Montana Legal Sports Betting – Latest Legislation News
The Montana Lottery has overseen the rapid expansion of hundreds of retail locations state-wide since sports betting became legal and went live in 2019. However, online sports betting, offered exclusively by the government-run board, is still largely restricted and looks set to remain so.
