The decade-long effort to overturn the Professional and Amateur Sports Protection Act (PASPA) culminated in 2018 when the Supreme Court ruled that each state has the authority to create its own sports betting legislation. Although multiple attempts have been made in recent years to legalize sports betting in South Carolina, there’s been very little progress to report. • May 2024 – HB 3749, a bill to legalize and regulate sports betting in the state, fails to make its way out of the committee before the year’s legislative session ends. The bill proposed online-only sports betting, as it is in Tennessee.
• March 26, 2024 – A spokesperson for the South Carolina Attorney General, Robert Kittle, via South Carolina Public Radio says, “Our office is not taking action on online gambling”.
• March 11, 2024 – Sports betting is launched in neighboring North Carolina, attracting sports bettors from its southern neighbors.
• April 21, 2022 – HB 5277 is introduced, proposing the legalization of sports betting, including on mobile devices. However, the bill dies in committee.
• January 12, 2021 – HB 3395, proposing an amendment to SC’s constitution on sports betting, horse betting, and casino gaming, is introduced. However, the bill was read only once in the House and died on referral to the Committee on Judiciary.
• May 14, 2018 – States are now allowed to make their own sports betting laws courtesy of a PASPA overturn.
• July 2017 – An Assemblyman, Adam Gray, proposed a constitutional amendment to overturn PASPA and legalize sports betting.

SC Sports Betting Taxation Laws

South Carolinians are not required to pay tax on their sports bet winnings because South Carolina online sports betting isn’t outright legal yet.
