Is Sports Betting Legal in Utah?
Utah legal sports betting is miles away. The state has no state-operated casinos or regulated sports betting sites, and there is a good chance it never will. Governor Gary Herbert stated in 2018 that the state would continue prohibiting sports betting even after overturning the Professional and Amateur Sports Protection Act (PASPA).
One of the Act’s original sponsors, Senator Orrin Hatch, a former Utah Senator, responded to the overturning by drafting federal legislation to stifle the spread of sports betting. Although this legislation didn’t pass, the move only shows how anti-gambling Utah is. Sports betting is currently classified as a Class B misdemeanor under Title 76, Chapter 10 of the state’s criminal code.
But that’s not to say you can’t place wagers in Utah. State residents can still bet on their favorite sports using offshore sportsbooks like BetOnline. Gambling is defined in Title 76, Chapter 10 of the state’s criminal code as
“Risking anything of value for a return or risking anything of value upon the outcome of a contest, game, gaming scheme, or gaming device when the return or outcome is based on an element of chance or in accord with an agreement or understanding that someone will receive anything of value in the event of a certain outcome.”
Since DFS technically involves participants selecting a roster of athletes and competing against each other based on their statistical performances in their various sports in real-world games, it can be argued that it does not fall under gambling. People who argue against DFS insist it shares characteristics with gambling, especially considering the financial stakes involved.
Sports Betting in Utah – Latest Legislation News
As discussed at length, legal Utah sports betting is unlikely to happen anytime soon. However, that hasn’t stopped a few cunning politicians from trying their luck in recent years.
- 2024 – A Utah legislator, Kera Birkeland, proposes HJR24, a bill to authorize a state-operated lottery and direct the profits to property taxes for seniors.
- 2022 – Sen. Hinkin proposes a horse racing amendment, S.B. 107, which defines terms and addresses the horse racing account, sources of revenue for the account, and the purpose of the revenue. However, the bill does not pass in the Senate.
- 2019—Sen. David Hinkins, a racehorse owner, sponsors S.B. 181, which would allow voters to decide whether their counties should allow part-mutual horse racing betting and wagering. Rep. Michael McKell also sponsored a companion bill addressing the Horse Racing Commission and licensing, but the bill did not pass.
- 2018 – The Supreme Court repeals PASPA, allowing all U.S. States, including Utah, to regulate sports betting at the state level.
Utah Sports Betting Taxation Laws
Utahns are not required to pay taxes on their sports betting winnings since Utah legal sports betting online is still on hold in the first place.
U.S. sportsbooks must report winnings to the Internal Revenue Service (IRS) per Section 6041 of the IRC, especially if the winnings exceed $600 and the payout is at least 300 times the wager amount.
